Emmanouil Koumianakis Jewellery offers this website, including all information, tools and services available from this site to the visitor conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
This Website and all materials, text, code, content, software, graphics, photographs, illustrations, artwork, formats, files, devices and links contained in it or linked to it (together « Content ») are protected by copyrights, trademarks and other intellectual property rights owned by or licensed to Emmanouil Koumianakis Jewellery.
Subject to the terms below, Emmanouil Koumianakis Jewellery takes steps to ensure that the information accessed via the Website is accurate and up-to-date but can give no guarantee or warranty as to the accuracy, timeliness or completeness of any information or material appearing on it. Emmanouil Koumianakis Jewellery reserves the right to correct the Website content at any time without prior notice and without liability.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to the visitor. The visitor hereby acknowledges that access to the Website may be interrupted at any time by Shopify Inc. for maintenance, security, or any other technical reason. Emmanouil Koumianakis Jewellery will not be liable if for any reason the Website is unavailable at any time or for any period.
Save for liability which Emmanouil Koumianakis Jewellery cannot by law restrict or exclude, Emmanouil Koumianakis Jewellery shall have no liability to visitors to the Website or any third party for any direct, special, indirect, consequential or incidental damages, exemplary or lost profits, or any other damages of any kind whether based on warranty, contract, tort, negligence or otherwise, even where Emmanouil Koumianakis Jewellery has been advised of the possibility of the same whether resulting from access to the Website, inability to access the Website or any information or material directly or indirectly provided through the Website or otherwise. This does not affect any liability of Emmanouil Koumianakis Jewellery for fraud or for death or personal injury arising from its negligence.
Emmanouil Koumianakis Jewellery hereby informs visitors that these general terms and conditions may be modified at any time. As soon as they are displayed online, each visitor who accesses the Website is deemed to have accepted these modifications without restriction. It is therefore the visitor’s responsibility to read these terms and conditions prior to browsing the Website.
Online Store Terms
1. These are the terms and conditions on which we supply products to you, when you order via our website http://koumianakis.gr/ (our "Website") or by telephone using our Client Service team.
Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.
2. Our products
2.1 Information about our products sold via our Website is available, with product references, in our store and on our Website. Products may vary slightly from their pictures. The images of the products on our Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
3. Placing orders and our contract with you.
3.1 Placing orders. All orders are subject to availability. Orders placed on the Site are subject to strict compliance with the procedures described below. Orders can be placed via our Website.
3.2 On the Site, the Customer selects, enters and validates the identification and quantity of the Items that he/she wishes to order said Items are added to the Customer’s “Shopping Cart”.
The Customer may freely modify his/her “Shopping Cart”, delete an initially selected Item, modify the quantities ordered or alternatively add an Item by clicking on the corresponding elements within the “Shopping Cart”.
3.3 Once the Customer has completed his/her selection and wishes to validate the contents of the “Shopping Cart”, the Customer can either login or continue as “guest”. The Customer can also login before selecting Items.
If the Customer already has a customer account, he/she can log in with his/her email address and password. If the Customer does not yet have an account, he/she can create one by confirming his/her name, address of residence, e-mail address and telephone number at the time he/she places the order.
The Customer's login details and password are intended to be used only by the Customer, therefore each Customer agrees to keep them secure and to not communicate them to third parties. The Customer agrees to immediately inform Emmanouil Koumianakis Jewellery in case of loss, theft or any fraudulent use of his/her customer account.
3.4 The Customer must also validate the delivery method and complete the information necessary for the proper dispatch of the order (country for shipment, delivery address or boutique where the Customer wishes to collect the order, if the selected delivery country has shops offering this service).
For a gift order, the Customer may include an accompanying card.
The Customer may use his/her delivery address as the billing address or enter another one. The Customer will then be asked to choose a payment method and complete the necessary information.
Once this information has been duly entered and validated, the price of the Items (as defined in Article 5 below) and any shipping costs shall automatically be displayed.
The Customer must verify the accuracy of his/her selection before confirming the order. At the end of the order process described above and after accepting all of these general terms and conditions of sale, the Customer clicks on "VALIDATE MY PAYMENT AND CONFIRM MY ORDER".
3.5 You must be 18 or over. We only accept orders from customers aged 18 and over.
3.6 Making sure your personalisation details are accurate. If we are personalising products in accordance with details you have given us you are responsible for ensuring that these details are correct.
3.7 Order acknowledgement. We will acknowledge receipt of your order without delay by sending a confirmation email, but this confirmation email does not constitute acceptance of your order even if you may be debited of all or part of the price of the products(s) immediately after we receive your order, including for the purposes of allowing us to carry out the security measures as set out in Article 5.
Our acceptance of your order will take place when we email you and tell you we have accepted it, at which point a contract will come into existence between you and us.
If we are unable to accept your order, we will inform you of this in writing (by email). This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product, because we are unable to meet a delivery deadline you have specified, or if the order is considered to be fraudulent or otherwise made in breach of these terms. In such cases, you will be notified in writing and we will not charge you for the product(s).
We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
4. Price and payment
4.1 The price of the product in euros (€) which includes VAT will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the product advised to you is correct.
If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
We do not provide VAT-refund service for orders placed on our Website.
4.2 We accept payments made through Stripe. At the time of order validation, you choose the "Stripe" payment option and will be automatically redirected to the "Stripe" platform. Payment processing services on the Services are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). You agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of our enabling payment processing services through Stripe, you agree to provide us with accurate and complete information about you and your business, and you authorize us to share it and transaction information related to your use of the payment processing services provided by Stripe.
The order shall be shipped only after verification of the payment method, verification of the conformity of the order with these general terms and conditions of sale and the availability of the Product(s). If we do not accept your order, we will refund any payments received within 14 business days.
If your payment cannot be processed for any reason (including, for example, stopped payment, refusal by the issuer of the card), your order will be cancelled and the contract with you ended immediately. We will inform you of this in writing (by email).
5. Security measures.
5.1 Payments through our Website are managed on-line with the relevant banking organisations through facilities offered by Stripe platform which enables us to accept and manage payments, mitigate fraud, and secure payment data. Your personal information including your name, email address, delivery details, telephone number, details of the order placed and credit card or other payment details will be disclosed and used by Stripe exclusively for the purposes of providing fraud screening services to us and to its own customers, as further detailed in our Privacy Policy. If you do not wish your personal information to be disclosed and used in this way, we will be unable to supply products to you. We reserve the right to put in place additional/other payment security system(s) from time to time.
6. Providing the products.
6.1 The costs of delivery will be as displayed to you on our Website.
6.2 You can expect to receive your order within 2-4 business days. If some jewelleries are out of stock we will contact you via email to inform you about the time it needs to be delivered. The products will in principle be delivered within 14 days at the latest from order confirmation, subject to full payment of the price, otherwise we will communicate in writing with you by explaining to you when you will receive the products.
The delivery deadlines referred to above are deemed indicative. Except if the delivery deadline was essential taking into account all the relevant circumstances and any correspondence between you and us, by default we do not consider delivery deadlines to be essential. Please let us know if you require that all or part of the products your order be delivered before a certain deadline.
We are not responsible for delays outside our control or due to any force majeure incidents such as pandemics, earthquakes, wars etc. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
6.3 If, at the time of delivery or collection by you, the packaging is damaged, please open the package in the presence of the carrier or store assistant in order to verify the condition of the products. In the case of delivery, where there is damage to the products, you should note the details on the delivery note and contact us. If we deliver products to you and products are lost or damaged by our carrier we will repair or replace the products free of charge (including costs of re-delivery) but only where:
- You tell us in writing within 24 hours of the actual delivery date in the case of damage and within 24 hours of the delivery date notified to you when you placed your order in the case of lost items (this is so that we will be able to meet our carrier's conditions of carriage);
- You produce to us any receipt or other documents relating to the products and (in the case of damaged items) the original packaging for the products complete with all related accessories, instruction booklets, labels, protective covers and boxes.
6.4 The products will be your responsibility from the time we deliver them to the address you gave us or, if you choose to collect your products from our store when you collect them from us.
6.5 You own the products on the later of the following:
- once we have received payment in full;
- once the products have been delivered to you or collected by you from us.
7. Returns
7.1 Withdrawal - According to law 2251/1994 if for any other reason than the one in article 7 you are not satisfied with a purchase, the product(s) can be returned for a product exchange or refund within 14 days of the order’s delivery date. You can use the Schedule Model Cancellation form below. You can deliver or send the products directly to our store. You must return the product(s) in their original packaging, complete with all related accessories, instruction booklets, labels, protective covers and boxes, together with the invoice. After that we will refund any sums you have paid to us for the cancelled products and their delivery. If the products have been delivered to you, you must allow us to collect them from you. We will pay the costs of collection. Please call us or email us to arrange collection.
7.2 You are not entitled to exercise your right of withdrawal in the cases of article 3b of law 2251/94 and in any other case that this is provided by law. That is, you cannot exercise your right of withdrawal in case where the price of the products has been paid in our physical store and in addition, where the products have been received from the physical store, as the sale is not considered to have been made from a distance.
7.3 We will pay the costs of return:
- if the products are faulty
- if you are ending the contract because we have told you of an error in pricing, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong; or
- if you are exercising your right of withdrawal by way of our complimentary collection service.
In all other circumstances you must pay the costs of return.
7.4 We will refund you the price you paid for the products including delivery costs, by the method you used for payment.
8. We may end the contract if you break it. We may end the contract for a product at any time by writing to you if:
- you do not make any payment to us when it is due;
- you do not, within a reasonable time, allow us to deliver the products to you or collect them from us.
- if by any means you intentionally don't fulfil your obligations derived from the contract.
9. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
10. Contracts through the online store are governed by European and Greek law, in particular by legislation governing matters relating to e-commerce, distance sales and consumer protection.
According to Directive 2013/11/EC, which was incorporated into Greek law by JM 70330/2015, it is now possible to electronically resolve consumer disputes through the Alternative Dispute Resolution process throughout the European Union. 11. Other important terms
11.1 Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
11.2 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
11.3 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.
11.4 These terms are governed by Greek law and you can bring legal proceedings in respect of the products in the courts of Crete/Athens.

RETURN POLICY
If for any reason you are not satisfied with a purchase, the item(s) can be returned for a product exchange, store credit or refund within 14 days of the order’s delivery date. Shipping charges are not refundable. In order for returns to be accepted, all items must be in perfect condition with security tag and original packaging. Please see also our terms of use.
Returns from countries outside the E.U. are not possible for items on sale. Returns are also not accepted for items that have been labelled NON-RETURNABLE in the product description. These are usually seasonal or customizable items for which we are unable to accept returns.
Emmanouil Koumianakis Jewellery reserves the right to refuse returns that are unauthorized and/or not sent in accordance with the return policy detailed online and in the Return Instructions accompanying an order. In the case of unauthorized or non-standard returns, the merchandise will be returned to the shipping address specified in the original order.
PRODUCT EXCHANGE: Items can be exchanged for a different size.
REFUND: Refunds will be processed within 5 working days from the date when returned items have been checked and accepted. Refunds can only be remitted to the initial credit card, Paypal or bank account used for paying for the order. Please note that processing time may vary depending on the bank or credit card company.
RETURN FEES

RETURN INSTRUCTIONS
Making a return or exchange is easy.
Just follow these instructions and make sure you send your item(s) back to us within 14 days of receiving your order.

Within the next two working days you will receive an email confirming your returns request and instructions on how to arrange your return collection.
Once we receive and accept your returned package, you will receive an email confirming your exchange, store credit or refund.
GIFT RETURNS
If you received a gift and would like to return it simply follow the instructions in the Gift Exchange Card included in your gift. Please note that gifts can only be exchanged for items of an equal or higher value. Store credit and refunds do not apply.
